Chapter 7 Bankruptcy

We represent individuals who want to permanently discharge certain debts under Chapter 7 in exchange for the sale of non-exempt assets. We will help you determine whether you qualify for protection under Chapter 7 by walking you through the law's "means test." If so, we will prepare all the documents necessary to complete the process and will act as your advocate in all meetings or hearings. See our Chapter 7 bankruptcy page to learn more.

Chapter 12 Bankruptcy

If you are a family farmer or fisherman, Chapter 12 bankruptcy may offer special benefits for you. Like a Chapter 13, this process would involve a repayment plan.

Chapter 13 Bankruptcy

If you are not eligible to discharge debts under Chapter 7 or you want to repay your creditors, we can help you reorganize your debt through a Chapter 13 filing. We will help you prepare and submit a plan of reorganization to your creditors and will review all proposed repayment plans, to make certain they are within your means. For more, go to our Chapter 13 bankruptcy page.

Real Estate

We handle a broad range of real estate matters, including landlord-tenant issues, home mortgage foreclosure, real estate litigation and real estate contracts. For additional information, see our real estate page.

How To Beat The Means Test And Avoid Chapter 13 Bankruptcy

Bankruptcy law requires almost every debtor to run his or her gross household income through the “means test” to compare it to other similar size households in the same state.  Debtors whose household income exceeds the median (as established by the Census Bureau) must file under Chapter 13 (or face a motion to convert or dismiss the case), unless their allowed expenses (payroll deductions, secured debt payments, and living expenses as allowed under IRS rules), leaves them essentially no income to pay creditors.  Filing under Chapter 13 means making burdensome monthly payments for five years. For additional information, see our How To Beat The Means Test And Avoid Chapter 13 Bankruptcy.

Though we focus our efforts on bankruptcy and real estate, we are a typical small town law office, providing counsel to clients on the broad range of legal problems faced every day.
